ARTICLE V. REGIONAL EMERGENCY MEDICAL SERVICES COUNCIL*

Sec. 15-72. Created.

There is hereby created and established a Broward Regional Emergency Medical Services Council.

Sec. 15-73. Objectives.

The Broward Regional Emergency Medical Services Council ("EMS Council") shall have the following objectives:

(a) Serve in an advisory role to the Broward County Board of County Commissioners ("Board").

(b) Serve as a catalyst to effect cooperative arrangements for improving and best utilizing emergency medical resources in Broward County.

(c) Survey existing emergency medical resources available to citizens and visitors to Broward County.

(d) Assist in the development of local and/or regional EMS plans.

(e) Make recommendations to the Board regarding emergency and nonemergency medical transportation services, first responder programs, training programs, communication systems, and other such appropriate facilities and services that significantly impact on the delivery of emergency medical services.

(f) Assist in the development of appropriate EMS standards of care and levels of service commensurate with the needs of the citizens of Broward County.

(g) Assist in securing emergency medical services related grants.

(h) Establish a standing committee known as the EMS review committee with the following objectives:

(1) Make recommendations to the Board, through the administrator, regarding new and renewal applications for certificates of public convenience and necessity for the provision of advanced life support (ALS) or basic life support (BLS) services, or for licenses for the provision of nonemergency medical transportation services as provided for in Chapter 3 1/2 of the Broward County Code of Ordinances and any rules and regulations promulgated thereunder; and

(2) Hold hearings, conduct investigations, and take testimony in certain matters relating to violations of Chapter 3 1/2 of the Broward County Code of Ordinances and any rules and regulations promulgated thereunder.

Sec. 15-74. Membership; terms.

(a) Membership.

(1) Members of the EMS Council shall be appointed by the Board. The EMS Council shall be composed of fifty-one (51) members. All members of the EMS Council shall be residents of Broward County except for the Broward County Medical Examiner, a Director of an Emergency Department in Broward Health, and a Director of an Emergency Department in Memorial Healthcare System, who shall not be required to reside in Broward County.

(2) One (1) member shall be a County Commissioner selected by a majority vote of the Board for a time period specified by the Board.

(3) Each Broward County Commissioner shall appoint one (1) member of the EMS Council.

(4) A name for each of the following categories or organizations shall be submitted to the Board by the EMS Council for consideration:

Pediatrician Prehospital Medical Director Broward County Medical Examiner Director of an Emergency Department in Broward Health
Director of an Emergency Department in Memorial Healthcare System

Hospitals:
Nonprofit Proprietary Broward Health, Administration
Memorial Healthcare System, Administration

Nurses:
Emergency room

Transport:
Non-fire based ambulance
Nonemergency Medical Transportation Service
Rotary air  
Fixed wing air

Advanced Life Support (ALS):
Municipal administration Municipal
paramedic County administration
County paramedic

Police and Fire:
County police Municipal
police County fire
Municipal fire

Basic Life Support (BLS):
Municipal emergency medical technician Private emergency medical technician Broward County Community College, Emergency Medical Services

(5) The Board may approve a nomination from the EMS Council for appointment or may appoint another individual who meets the criteria of the particular category of membership sought to be filled.

(6) Staff assistance and appropriate resources shall be rendered to the EMS Council by the Broward County Trauma Management Agency.

(b) Terms of Members; Removal.

(1) The nine (9) members appointed to the EMS Council pursuant to Subsection 15-74 (a)(3) shall serve terms in accordance with the provisions of Section 1-233 of the Broward County Code, as may be amended from time to time.

(2) The members appointed to the EMS Council pursuant to Subsection 15-74(a)(4)  
shall serve at the pleasure of the Board for a term of four (4) years.

(3) Any member appointed to the EMS Council who has three (3) consecutive absences or misses four (4) meetings in one (1) calendar year shall be automatically removed as a member of the EMS Council. Automatic removal of a member shall cause a vacancy to exist in the membership of the EMS Council. However, the automatic removal of a member shall not be deemed effective until the member has received written notice from the County Administrator or designee of the reason for the action being taken to remove the member. In the event a member is automatically removed, the EMS Council may (i) nominate a new individual and submit the name to the Board for consideration for appointment or (ii) recommend to the Board that the individual be reappointed when extenuating circumstances are found to exist for the individual's absences. Thereafter, the Board may approve the EMS Council's nomination of a new individual for appointment, reappoint the individual to the EMS Council for the remainder of the unexpired term, or appoint another individual who meets the criteria of the particular category of membership sought to be filled.

(4) Vacancies in the membership of the EMS Council shall be filled in the same manner provided for the original appointments. An appointment to fill a vacancy shall only be for the remainder of the unexpired term being filled.

(5) All members serving on the EMS Council as of the effective date of this ordinance who fall within one (1) of the categories of membership referred to in Subsection 15-74 (a)(4) shall continue to serve their respective terms as provided for herein.

(c) Committees; Staff.

(1) The EMS Council may establish subcommittees as specific needs arise. The Chair of the EMS Council shall appoint subcommittee Chairs and members to such subcommittees as needed.

(2) All meetings of any committee shall be open to the public and advertised as provided by law.

Sec. 15-75. Meetings.

(a) Regular Meetings. The EMS Council shall meet quarterly and at other times as necessary.

(b) Special Meetings. Special meetings of the EMS Council may be called by the Chair, or at the request of half of the appointed membership.

(c) Quorum. Notwithstanding Subsection 1-233(j), Broward County Code of Ordinances, a quorum for the EMS Council meetings shall be one-third ( 1/3) of the appointed members.

(d) Voting at Regular or Special Meetings. A simple majority of votes entitled to be cast on a matter by the appointed members present shall be necessary for adoption.

(e) Meeting Minutes. Minutes of meetings shall be provided to all EMS Council members at least one (1) week in advance of the next meeting.

Sec. 15-76. Officers.

The EMS Council shall have the powers and authority to elect such officers and promulgate such internal procedures and rules as may be necessary to conduct the business of the EMS Council.

Sec. 15-77. Reports.

The EMS Council may provide the Board with an annual report setting forth in appropriate detail the business transacted during the year and the status of the EMS Council at the close of the year. The EMS Council shall furnish to the Board such additional reports and information as may be required from time to time.
