Purpose
Provide for procedures to register and license individuals who perform a variety of construction trades in Broward County; issue Certificates of Competency to individuals practicing the various construction trades in the County; insure that individuals practicing the various construction trades are properly insured; provide the public a means by which to register complaints, mediate disputes, and to be heard with respect to issues which arise during construction.

Broward County Ordinance #78-9, enacted January 18, 1978, amended Chapter 9 of the Broward County Code by repealing former Chapter 9 and adopting a new Chapter 9, establishing the Central Examining Boards (CEB) of: Plumbing and Specialty Plumbing Contractors; Electrical and Specialty Electrical Contractors; General and Specialty Building Contractors; Mechanical and Specialty Mechanical Contractors; Liquefied Petroleum Gas Contractors; and Engineering and Specialty Engineering Contractors. The former Chapter 9 had been derived from numerous Special Acts of Florida and the following Broward County Ordinances: 71-2, 71-6, 72-6, 73-1, 75-40, 76-12, and 77-13.
Amended by Ordinance #79-36, enacted June 20, 1979, providing a single uniform ordinance, applicable to the Central Examining Boards, for terms of appointees on County boards, authorities, and agencies to serve at the pleasure of the nominating Commissioner.
Amended by Ordinance #90-18, enacted July 10, 1990, changing the name to Central Examining Board of Mechanical Contractors and Specialty Mechanical Contractors; revising qualifications and classifications.
Amended by Ordinance #92-32, enacted September 8, 1992, establishing minimum levels of practical experience prior to certifications in the categories of mechanical and specialty mechanical contractors.
Amended by Ordinance #92-33, enacted September 8, 1992, requiring that individuals who perform test and balance of mechanical systems be licensed and/or certified.
Amended by Ordinance #94-27, enacted May 10, 1999, amending numerous sections of Chapter 9; revising Specialty Building Contractor categories; revising standards for Liquid Petroleum Gas Contractors.
Amended by Ordinance #1999-51, enacted September 28, 1999, revising qualifications for test and balance contractors.
Amended by Ordinance #2000-40, enacted September 26, 2000, amending Sections 9-12, 9-41 and 9-42 of Chapter 9; re-establishing the Central Examining Boards of: Plumbers; Electricians; Engineered Construction Trades; Building Construction Trades; Mechanical Contractors and Specialty Mechanical Contractors; Liquefied Petroleum Gas Technicians; increasing the membership of each Central Examining Board except for the Boards of Liquid Petroleum Gas Technicians and Electricians; adding consumer representatives; requiring four (4) of the boards to meet a minimum of eight (8) times a year; requiring the other two (2) boards to meet a minimum of four (4) times a year; providing reciprocal certification for Liquid Petroleum Gas Contractors.
Amended by Ordinance #2003-16, enacted May 13, 2003; establishing a schedule of civil penalties which can be levied against licensed contractors who violate the Building Code; creating a restitution fund; revising the membership, appointment, qualifications, and vacancy provisions of the Central Examining Boards to conform to the Charter revisions of November 2002.
Membership
Nine (9) members.
(1) The Broward County Commission shall appoint five (5) members consisting of three (3) professional members and two (2) consumer representatives.
(2) The Broward County League of Cities shall appoint four (4) members consisting of three (3) Professional members and one (1) consumer representatives.
A Professional Member shall be an individual who has been active in their respective craft or trade for not less than ten (10) years within Broward County.
A Consumer Representative shall be any person who resides in the County who is not, and has never been a member or practitioner of a profession regulated by the board or a member of any closely related profession.
DUAL OFFICEHOLDING:
The Florida Constitution prohibits a person from simultaneously holding more than one office under the government of the state, counties, and municipalities. The prohibition applies to both elected and appointed offices. It is not necessary that the two offices be within the same governmental unit.
Terms
The members appointed by the County Commission shall serve until the expiration of the term of the nominating Commissioner, or until a successor is duly appointed.
The members appointed by the Broward County League of Cities shall serve for a term of four (4) years, or until a successor is duly appointed.
Members of the CEB’s may serve three (3) consecutive four (4) year terms.
The appointing authority may remove any board member appointed by it for misconduct, incompetency or neglect of duty on its own motions or upon recommendation of a majority of the respective board. Neglect of duty shall include, but not limited to, a member’s absence, without good and sufficient cause, from three (3) consecutive regular of special meetings of the board or four (4) regular or special meetings in one (1) calendar year.
A vacancy shall be filled for the remainder of the former member’s term of office.
Quorum
A majority of the appointed members of a board shall constitute a quorum at any meeting. A majority vote of those present and voting shall be required to make any decision unless otherwise provided in Chapter 9, Broward County Code of Ordinances.
